OSHA Porta Potty Requirements for Texas Construction Sites
What the federal rule says, how to count toilets for your crew, and where builders get it wrong.

How many toilets does OSHA require on a construction site?
OSHA requires 1 toilet for 20 or fewer workers on a construction site. Sites with 20 or more workers need 1 toilet seat and 1 urinal per 40 workers, and 200 or more workers need 1 seat and 1 urinal per 50. The rule is OSHA 29 CFR 1926.51, Table D-1, and it applies to Texas sites under federal OSHA.
| Workers | Minimum facilities |
|---|---|
| 20 or fewer | 1 |
| 20 or more | 1 toilet seat and 1 urinal per 40 workers |
| 200 or more | 1 toilet seat and 1 urinal per 50 workers |
When is a porta potty not required?
A porta potty is not required on a construction site when crews have transportation readily available to nearby toilet facilities, according to OSHA 1926.51(c)(4) for mobile crews. In practice, Temple homeowners rarely want roofers or framers using the house, so a unit is the simple answer.
Does OSHA require hand washing on job sites?
OSHA 1926.51(f) requires washing facilities where workers apply paints, coatings, herbicides or insecticides, or work with other contaminants. Washing facilities must be near the work and kept sanitary. A two-sink hand-wash station placed next to the porta potty meets that need on most Temple sites.
What does a minimum setup miss?
The legal minimum of 1 toilet for 20 workers keeps a site compliant but leads to lines and full tanks by day 5. We recommend 1 standard unit per 10 workers on a 40-hour week with weekly service, and a second weekly service for crews over 10 in July and August, when Temple highs reach the upper 90s.

Does a 2-person crew need a porta potty?
Under OSHA, a crew of 20 or fewer needs at least 1 toilet unless they have quick transportation to a nearby restroom. A 2-person crew working all day on a site with no restroom should have 1 unit.
Who is responsible for the porta potty on a job, the GC or the sub?
OSHA holds the employer responsible for its own workers. On most Temple jobs, the general contractor rents units for all trades, and the contract says so.
